Contents of a Domestic Tourism Business License
Currently, tourism activities in Vietnam are significantly developing in the direction of increasing the number of tourists and improving the quality of services. Therefore, it requires enterprises to operate more and more professionally and effectively with Domestic Tourism Business Licenses.
What is a tourism business?
Pursuant to the Law on Tourism 2017, a tourism business is the construction, sale and implementation organization of all or part of a tourism program for tourists. In which, the tourism program is understood to be a document presenting schedules, services and prices predetermined for the tourists’ trips from the starting point to the end point of the trips.
Tourism business activities are divided into domestic tourism businesses and international tourism businesses. The tourism business has to meet the conditions prescribed by law, and there are different conditions depending on each specific type of service. For domestic tourism activities, the enterprises have to meet the following conditions to be granted the Domestic Tourism Business License:
a) Being enterprises established in accordance with the Law on Enterprise;
b) Having an escrow for domestic tourism business at the bank; with an escrow level of 20,000,000 VND (twenty million Vietnamese dong) according to Decree 94/2021/ND-CP amending and supplementing Decree 168/2017/ND-CP. However, from January 1st, 2024, the escrow level will be applied again according to Decree 168/2017/ND-CP, which is 100,000,000 VND (one hundred million Vietnamese dong).
During the Covid 19 pandemic, tourism activities almost came to a standstill and tourism businesses all fell into crisis, some enterprises were currently having negative capital. Therefore, to help enterprises overcome difficulties, the Government reduced the escrow level of 20,000,000 VND to support enterprises in re-operating tourism business activities.
c) Persons in charge of tourism business have to graduate from intermediate levels or higher in tourism professionals; If graduating from intermediate levels or higher in other professionals, they need to have certificates of tourism operation business.
In general, the conditions for granting the Domestic Tourism Business License are not too complicated or difficult for enterprises, and the current escrow level is also a suitable level that enterprises can meet.
An application dossier for granting the Domestic Tourism Business License
To be granted the Domestic Tourism Business License, enterprises need to prepare the following documents:
a) Proposal for granting the Domestic Tourism Business License in the form prescribed by the Minister of Culture, Sports and Tourism;
b) Authenticated copy of the Enterprise Registration Certificate;
c) Escrow certificate for tourism business;
d) Authenticated copies of the appointment decisions or labor contracts between the tourism enterprises (employers) and persons in charge of tourism business (employees);
e) Authenticated copies of diplomas and certificates of persons in charge of tourism business in accordance with the Law.
After submitting the dossier to the provincial tourism authority where enterprises are headquartered, specifically the Department of Culture, Sports and Tourism; within 10 days from the date of receiving the valid dossier, the Department of Culture, Sports and Tourism will assess and grant the Domestic Tourism Business License to enterprises.
