I. Current demand for business household establishment services

1. Who is eligible to use business household establishment services?

According to Decree No. 01/2021/ND-CP, individuals or family members are entitled to register as an individual business household. Users of legal services must:

3. Which business sectors are prohibited from being registered through such a service?

According to Article 6 of the Investment Law 2020, the following business sectors are prohibited:

1. Trading in narcotics listed in Appendix I of the Investment Law 2020;

2. Trading in chemicals and minerals listed in Appendix II of the Investment Law 2020;

3. Trading in specimens of wild plants and animals of natural origin as prescribed in Appendix I of the Convention on International Trade in Endangered Species of Wild Fauna and Flora; specimens of endangered, precious and rare forest plants, animals and aquatic products of Group I as prescribed in Appendix III of the Investment Law 2020;

4. Trading in prostitution services;

5. Trading in buying and selling humans, tissues, corpses, body parts, or human embryos;

6. Trading in activities related to human cloning;

7. Trading and producing firework;

8. Trading in debt collection services.

The production and use of products listed in points (1), (2), and (3) for scientific research, healthcare, pharmaceuticals, crime investigation, national defense, and security must comply with specific government regulations.

Thus, investment in the 8 sectors listed above is strictly prohibited.

III. Questions about business household establishment services

1. Can a household register for business operations in multiple locations?

According to Article 86 of Decree No. 01/2021/ND-CP, a business household may operate in multiple locations, but must:

- Select one primary location for official registration;

- Notify the tax authority and market management agency for other business locations.

2. Which authority issues the business household registration certificate?

Under Clause 1, Article 87 of Decree No. 01/2021/ND-CP, the registration is handled by the District-level Business Registration Authority, specifically the Department of Economics or the Department of Finance and Planning of the district where the household is located.

3. What are the conditions for using a business household establishment service?

- The registrant must have full civil act capacity (as defined in the Civil Code 2015);

- The business activity must not fall under the prohibited sectors listed in the Investment Law 2020;

- There must be a clear business location, compliant with regulations.

4. Is notarization required when using a business household establishment service?

Yes, notarization is required if you authorize the service provider to act on your behalf. This includes:

- Notarized documents;

- A Power of Attorney agreement authorizing the service provider to implement procedures on behalf of the client.

5. How long does the business household establishment service take?

The duration depends on how quickly the client provides all necessary documents. Once received, the service provider will:

- Submit the application to the Department of Finance and Planning;

- Await approval, typically within 3 working days after submission.
