2. What is a legal consulting center?
A legal consulting center is understood to be an organization established under legal regulations to carry out activities aimed at consulting and resolving legal issues for the community.
According to Article 5 of Decree No. 77/2008/ND-CP, a legal consulting center can be established when the following two conditions are met:
Firstly, regarding personnel, there must be at least two legal consultants or one legal consultant and one practicing lawyer working under a labor contract, or two practicing lawyer working under a labor contract;
Secondly, the center must have a working office.
The legal consulting centers carry out their activities for free or for a fee to generate operational funding for the centers, as specified in Article 10 and 11 of Decree No. 77/2008/ND-CP. If the center provides entirely free legal services, the funding is sourced from:
- Operational funds allocated in the regular budget of the socio-political organization for legal consulting centers established by the socio-political organizations;
- Funding from legal aid programs for legal consulting centers registered to participate in legal aid according to legal aid laws;
- Support from socio-political professional organizations, social-professional organizations, educational institutions, specialized legal research institutions, derived from revenue from their activities; and donations from individuals, domestic and international organizations supporting legal consulting activities under legal provisions.
3. What are activities of legal consulting centers?
The scope of activities for a legal consulting centers is specified in Article 7 of Decree No. 77/2008/ND-CP, and guided by Article 3 of Circular 01/2010/TT-BTP, including:
- Legal guidance and explanations;
- Legal advice and opinions;
- Drafting of applications, contracts, wills, and other documents;
- Providing legal documents and information;
- Assigning lawyers working under the labor contract with the center to participate in litigation, defense, and protection of the legal rights and interests of individuals and organizations as requested;
- Providing legal aid according to legal provisions;
- Non-litigation representation for those receiving legal consultations to perform legal-related tasks, except where otherwise provided by laws.
